Definitions
For the purposes of these Terms of Service, the following definitions apply:
- Service — the Samlla web platform available at samlla.com, used for personal journaling and habit tracking.
- Operator — the entity managing the Samlla platform (samlla.com).
- User — a natural person who has registered an account and uses the Service.
- Account — the individual User profile created during registration.
- User Content — all data entered by the User within the Service, including journal entries, trackers, and goals.
- Terms — this document setting out the rules for using the Service.
Conditions of Use
Use of the Service is permitted only under the terms set out in these Terms of Service. By registering and using the platform, the User confirms that they:
- have read and accept these Terms,
- are at least 16 years of age or have obtained parental/guardian consent,
- have provided truthful and current registration data.
The Operator reserves the right to refuse to provide the Service or delete an account in the event of a breach of these Terms.
Registration and Account
Use of the Service requires creating an account. Registration is carried out via the Kinde service (kinde.com) using an email address.
The User is obliged to:
- provide truthful registration data,
- keep their account access credentials confidential,
- promptly notify the Operator of any suspected unauthorized access to the account (support@samlla.com),
- not share their account with third parties.
The Operator is not responsible for damages resulting from the User losing their access credentials.
User Content
Ownership of Content
The User retains full intellectual property rights to the User Content they submit (journal entries, trackers, goals).
License to Process
By using the Service, the User grants the Operator a non-exclusive, royalty-free license to store, process, and display User Content solely to the extent necessary to provide the Service. This license expires upon deletion of the account or the relevant content.
Responsibility for Content
The User bears sole responsibility for the content they submit. The Operator does not verify, moderate, or take responsibility for User Content.
Permitted and Prohibited Use
Permitted Use
The Service is intended for:
- personal journaling and reflection,
- tracking habits, goals, and activities,
- personal management of progress and data.
Prohibited Use
It is prohibited to use the Service to:
- send spam, bulk messages, or unsolicited content,
- install or transmit malicious software (malware, viruses, trojans),
- violate the privacy of others,
- impersonate other individuals or entities,
- engage in activities contrary to applicable law,
- attempt unauthorized access to the Operator's systems or other Users' accounts,
- engage in activities that may disrupt or overload the Service infrastructure.
Violation of the above rules may result in immediate account deletion.
Liability and Limitations
The Service is provided on an "as-is" basis. The Operator:
- does not guarantee uninterrupted availability of the Service,
- is not responsible for data loss resulting from technical failures, provided due diligence has been exercised in creating backups,
- is not responsible for consequences of using the Service contrary to these Terms,
- is not responsible for content submitted by Users,
- reserves the right to introduce changes to Service features.
To the maximum extent permitted by applicable law, the Operator's liability is limited to actual direct damages.
Service Availability
The Operator makes every effort to ensure the Service is available 24 hours a day, seven days a week. However, the Operator reserves the right to:
- schedule technical downtime (maintenance, updates) — the Operator will endeavor to provide advance notice of planned outages,
- temporarily restrict access in the event of failures or security threats.
The Operator does not guarantee any SLA-level availability of the Service.
Changes to Terms
The Operator reserves the right to amend these Terms of Service. In the event of material changes, Users will be notified:
- by email to the address associated with their account, or
- by a message displayed upon login.
Changes take effect on the date specified in the notification, with no less than 14 days' notice. Continued use of the Service after changes take effect constitutes acceptance of those changes.
Termination / Account Deletion
Account Deletion by the User
The User may delete their account at any time via the option available in profile settings or by contacting support@samlla.com. Upon account deletion, User Content is permanently erased within 30 days.
Termination by the Operator
The Operator may delete a User's account in the event of:
- breach of the Terms of Service,
- prolonged account inactivity (more than 24 months),
- discontinuation of the Service.
In the event of the Service being discontinued, the Operator will notify Users with at least 30 days' notice.
Governing Law and Jurisdiction
These Terms are governed by applicable law. Any disputes arising from the use of the Service will be resolved by the competent courts.
Users who are consumers may have the right to alternative dispute resolution. More information is available on the ODR platform: https://ec.europa.eu/consumers/odr.
